Fields of jurisdiction
The Agency has jurisdiction for the whole national railway system. As foreseen in the Safety Directive and in art. 6 of D. Lgs. 162/2007 (transposition of Directive 2004/49), ANSF carries out tasks concerning:
- norms
- authorisations
- supervision
Following special international agreements, the safety jurisdiction for cross-border infrastructure could be entrusted to the Agency, to the neighbouring NSA or to a specific bi-national organization which ANSF can take part in.
They are still valid the existing Italian laws for the other jurisdictions concerning safety confided to other entitled public bodies; in particular:
- Ministry of Interior for fire prevention and urgent technical assistance;
- Ministry of Labour and Social Policy for the health and safety of the workers;
- Ministry of Infrastructures and Transports for the civil public works in the phase of their carrying out.
Finally, the Agency does not have jurisdiction on:
- metros, trams and other light rail systems;
- networks that are functionally separate from the rest of the railway system and intended only for the operation of local passenger services,
- privately owned railway infrastructure that exists solely for use by the infrastructure owner for its own freight operations
Referring to the regional networks the enforcement of D. Lgs. 162/2007 is postponed by three years, in order to permit the unification of norms, standards and safety procedures.
